In Finnis´s methodology it is very important to build the appropriate concepts to describe, analyse and define law. As a natural law theorist Finnis goes beyond Hart when considering that the internal point of view is useless for delimiting what law is if one does not define the internal point of view of the internal point of view, that is, the moral point of view. Only from a moral point of view it is possible, according to Finnis, to build an (...) authentic theory of law able not only to describe law but also to morally evaluate it. In Finnis methodology there is also the distinction between the focal and peripheral meanings of a term or concept, whichcorrespond, respectively, to the central and peripheral or secondary cases of and object referred by such term or concept. Because of this distinction Finnis is able to use a wide concept of law avoiding in this way many of the mistakes, which, according to legal positivism, are typical of natural law theories like, for example, confusing legal and moral validity. The importance given by Finnis to the internal point of view and the distinction between central and peripheral cases in order to analyse law is not original but Finnis introduces some particularities, which is what I try to present in this paper. En el artículo se ofrece un análisis crítico de la misión como inculturación del Evangelio, desde una perspectiva filosófico-teológica. Para comenzar, se exponen las deficiencias de la evangelización colonizadora en América. Posteriormente, se proponen dos posibles sentidos de la plantatio ecclesiae como meta de la misión. The article explores the specific conception of art developed by Danko Grlić, a prominent member of the Yugoslav Praxis School. Grlić conceptualised art beyond both aesthetic norms and technological determinism. Within the context of praxis philosophy, a distinct theory of the subject and a Marxist humanist approach, he reconceptualised art as a distinct type of praxis, a revolutionary and creative practice of changing existing living conditions. The article explains how his unique understanding of art leads Grlić to analyse, criticise and (...) refute various Marxist approaches to art: art as an ideology, art as a reflection of the objective world, art as sociological analysis. Moreover, while sharing many ideas and conceptions with Walter Benjamin’s materialist conception of art, Grlić reached the point where he became critical due to Benjamin’s belief in technology concerning processes of emancipation, which Grlić viewed with scepticism. The paper explores Sreten Petrović’s contribution to Marxist aesthetics. Petrović developed his theory within the framework of the Yugoslav Praxis School, although he was not a member of it. Petrović followed Danko Grlić, a prominent member of the Praxis School, in explaining art as a specific emanation of praxis – free, creative, autonomous and self-emancipatory activity beyond the commodity form of capitalist society. Art was thus understood as the liberation and emancipation of Being and its essence. However, Petrović also introduced (...) a novelty – he claimed that art can never be fully understood nor explained. According to him, the only true Marxist aesthetics, given our limited cognitive abilities and the capitalist imperative of producing commodities, would be to limit aesthetics to meta-aesthetics and affirm the ‘critique of the aesthetic mind’. We argue that by limiting aesthetics to meta-aesthetics Petrović is following the young Wittgenstein and his proposition that the world is unintelligible to philosophy. Accordingly, we claim that Petrović’s contribution should be seen as an important contribution to Marxist aesthetics. (shrink)

Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

La acción de grupo presentada por causa del derrumbe del Relleno Sanitario Doña Juana, finalizó con un fallo del Consejo de Estado, en el que se aplicaron estándares de reparación integral en el año 2012, que ameritan un seguimiento y análisis. En esta investigación, se indagó si las medidas de justicia restaurativas aplicadas al relleno sanitario han sido efectivas para la población afectada; por lo cual se construyó una matriz descriptiva que da cuenta del estado de la garantía de derechos, (...) con los siguientes hallazgos: en cuanto a los perjuicios tasados no se pagó de manera oportuna la sentencia judicial, lo que se vinculó a una percepción de confusión por parte de los afectados, y continúan las vulneraciones a la intimidad familiar, a la recreación y utilización del tiempo libre, al medio ambiente sano y a la salud pública y, de manera indirecta, a los derechos civiles y políticos. In this paper I explore some of the moral issues that could emerge from the creation of human–nonhuman chimeras capable of human gamete production and human pregnancy. First I explore whether there is a cogent argument against the creation of HNH-chimeras that could produce human gametes. I conclude that so far there is none, and that in fact there is at least one good moral reason for producing such types of creatures. Afterwards I explore some of the moral problems that (...) could emerge from the fact that a HNH-chimera could become pregnant with a human conceptus. I focus on two sets of problems: problems that would arise by virtue of the fact that a human is gestated by a nonhuman creature, and problems that would emerge from the fact that such pregnancies could affect the health of the HNH-chimera. In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

The use of technologies like artificial intelligence can drive productivity growth, efficiency and innovation. The goal of this study is to develop an anomaly detection method for locating flaws on the surface of sandwich panels using YOLOv5. The proposed algorithm extracts information locally from an image through a prediction system that creates bounding boxes and determines whether the sandwich panel surface contains flaws. It attempts to reject or accept a product based on quality levels specified in the standard. To evaluate (...) the proposed method, a comparison was made with a sandwich panel damage detection method based on a convolutional neural network and methods based on thresholding. The findings show that the proposed method, which is based on an object detector, is more accurate than the alternatives. The characteristics of the model, which can reject or accept a product according to the standard and limit allowable manufacturing flaws to obtain a quality product, also enable this system to improve industrial standards for producing sandwich panels while increasing speed. The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)

Background:The decision whether to initiate cardiopulmonary resuscitation may sometimes be ethically complex. While studies have addressed some of these issues, along with the role of nurses in cardiopulmonary resuscitation, most have not considered the importance of nurses acting as advocates for their patients with respect to cardiopulmonary resuscitation.Research objective:To explore what the nurse’s advocacy role is in cardiopulmonary resuscitation from the perspective of patients, relatives, and health professionals in the Basque Country (Spain).Research design:An exploratory critical qualitative study was conducted from (...) October 2015 to March 2016. Thematic analysis was used to analyse the data.Participants:Four discussion groups were held: one with patients and relatives (n = 8), two with nurses (n = 7 and n = 6, respectively), and one with physicians (n = 5).Ethical considerations:Approval was obtained from the Basque Country Clinical Research Ethics Committee.Findings:Three significant themes were identified: (a) accompanying patients during end of life in a context of medical dominance, (b) maintaining the pact of silence, and (c) yielding to legal uncertainty and concerns.Discussion:The values and beliefs of the actors involved, as well as pre-established social and institutional rules reduced nurses’ advocacy to that of intermediaries between the physician and the family within the hospital environment. On the contrary, in primary health care, nurses participated more actively within the interdisciplinary team.Conclusion:This study provides key information for the improvement and empowerment for ethical nursing practice in a cardiac arrest, and provides the perspective of patients and relatives, nurses and physicians. El presente ensayo busca, principalmente, acceder de modo crítico a la interrogante de si acaso los contenidos de las experiencias perceptuales son estructurados y compuestos por conceptos de un modo análogo a actitudes proposicionales como la creencia y el deseo; para así establecer y transparentar dos argumentos –la importancia del factor contextual y la condición de re-identificación– que se constituyen, en cierta medida, como un obstáculo para la postura conceptualista. Ambos argumentos suponen una problemática a la visión que enfatiza que (...) en todos los casos el contenido de una experiencia perceptual contiene necesariamente conceptos que especifican a cabalidad cada uno de los elementos disponibles a nivel consciente durante dicha experiencia al mismo tiempo, es decir, la visión que asevera que el contenido de las experiencias perceptuales es irremediablemente conceptual, y que estos conceptos son capaces de detallar y especificar las propiedades y los objetos dispuestos en la experiencia perceptual. Como lectores contemporáneos de una tragedia clásica griega, como lo es Edipo Rey, nos sentimos impresionados por el carácter existencial y la universalidad de este texto dramático, que hace que cada re-lectura parezca siempre una nueva lectura. Al abordar el texto, se abre una dimensión existencial que permite que surja la dialéctica de la comprensión / mal-comprensión que al actuar como espejo de los sujetos les permite leer / develar el mundo al que pertenecen. Este ensayo se centra en los (...) momentos existenciales o demarcaciones llevadas a cabo por las distinciones de la semiótica existencial entre el ser y el ser profundo .As contemporary readers of a Classical Greek Tragedy such as Oedipus Rex, we feel deeply moved by the existentiality and universality of the dramatic text, which make every re-reading seem ever a new one. The reading of the text opens up an existential dimension allowing the understanding / misunderstanding dialectics that, acting as a mirror for the subjects allows them to read / unveil the world to which they belong to. This essay then will focus on existential moments or demarcations brought about by the Moi / Soi existential semiotic distinctions. (shrink)
